Terms of Service

1. Eligibility and age

You must be at least 13 years old to use OmeBate. By using OmeBate, you confirm you meet this minimum age. If you are between 13 and 17, you confirm that a parent or guardian has reviewed and agreed to these terms on your behalf. OmeBate does not knowingly allow children under 13 to create accounts or participate in debates.

2. Use of the service

By using OmeBate, you agree to follow these terms and all applicable laws and local regulations. You must be legally permitted to use online services in your country or region.

3. Account and access

Accounts are optional. If you create one, you are responsible for safeguarding your sign-in credentials and for all activity under your account. Notify us immediately at legal@omebate.com if you suspect unauthorised access.

4. Acceptable conduct

You may not use OmeBate to: harass, threaten, or abuse other users; post hate speech, discriminatory content, or illegal material; doxx or share personal information about others without their consent; spam, impersonate others, or operate bots; or attempt to exploit, hack, or otherwise abuse the platform. Violations may result in content removal, suspension, or permanent account termination.

5. Content you submit

When you participate in a debate, send messages, or otherwise submit content through OmeBate, you grant OmeBate a worldwide, royalty-free, perpetual, irrevocable licence to use, store, reproduce, modify, and distribute that content for the purpose of operating and improving the service, including for AI verdict generation.

You retain ownership of your content and may request deletion by contacting us at privacy@omebate.com. Deletion is subject to technical feasibility and legal retention requirements.

6. Data collection and third-party licensing

OmeBate collects platform usage data including debate transcripts, topic preferences, session behaviour, device and browser information, and engagement signals. This data is used to operate, maintain, and improve the service.

OmeBate may share anonymised, aggregated, or pseudonymised datasets derived from platform usage with third parties (including AI companies, research organisations, and commercial data partners) for purposes such as AI model training, language research, and behavioural analytics. Directly identifying information (name, email address) is never included in such datasets.

You may opt out of your content being included in third-party data licensing at any time by emailing privacy@omebate.com with the subject “Data licensing opt-out”. See our Privacy Policy for full details.

7. AI verdicts

AI verdicts are automatically generated outputs and may be imperfect, biased, or incorrect. They are provided for entertainment purposes only and do not constitute legal, educational, professional, or factual advice. We make no warranty as to the accuracy or fairness of any verdict.

8. Premium subscriptions

Certain features are available as optional paid subscriptions (“Premium”). Billing is handled by Stripe, Inc. on our behalf. By subscribing you also agree to Stripe's Services Agreement.

  • Auto-renewal: Subscriptions renew automatically at the end of each billing period (monthly or annual as selected) unless cancelled before the renewal date. The renewal charge is at the then-current price.
  • Price changes:We will give at least 30 days' notice of any price increase via email before the change takes effect.
  • Cancellation: You may cancel your subscription at any time from your account settings or by emailing billing@omebate.com. Cancellation takes effect at the end of the current billing period; you retain Premium access until then.

9. Refunds

All subscription fees are non-refundable except as required by applicable law.

EU and UK consumers: Under the EU Consumer Rights Directive and the UK Consumer Contracts Regulations you normally have 14 days to cancel a digital service. However, by subscribing and immediately accessing Premium features, you expressly consent to the service beginning before the 14-day period expires and acknowledge that this waives your statutory right of withdrawal for the period already used. If you cancel within 14 days and have not accessed any Premium features, you are entitled to a full refund — contact billing@omebate.com.

We may issue refunds at our discretion where there has been a technical error or service failure attributable to OmeBate.

10. Disclaimer and limitation of liability

OmeBate is provided “as is” and “as available” without warranties of any kind, express or implied. To the maximum extent permitted by applicable law, OmeBate is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of data, revenue, or goodwill.

Nothing in these terms limits liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

EU and UK consumers: These terms do not affect any statutory rights you have as a consumer that cannot be waived by contract.

11. Governing law and jurisdiction

These terms are governed by the laws of England and Wales. Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where applicable consumer protection laws in your country of residence give you the right to bring proceedings before your local courts.

12. Dispute resolution

We encourage you to contact us first at legal@omebate.com before raising a formal dispute. We will try to resolve complaints within 14 days. If we cannot reach agreement, disputes shall be resolved through the courts of England and Wales (subject to any mandatory consumer rights in your jurisdiction).

EU consumers: The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr.

13. Changes to these terms

We may update these terms from time to time. When we make material changes, we will notify registered users by email at least 14 days before the changes take effect. Continued use of OmeBate after the effective date constitutes acceptance of the revised terms.
